Cyclists in Roundabout Accidents Win Damages

Two cyclists who were hit by cars whilst negotiating roundabouts have been awarded compensation for their injuries.

In the first case, David Collins was thrown from his bicycle when it was hit from behind by a car. The driver had failed to spot the cyclist’s position on the road. Mr Collins suffered soft tissue injuries and his bicycle was damaged.

Following an investigation, the driver’s insurer accepted liability for the accident. Mr Collins received an undisclosed amount in compensation for his personal injuries, for the damage to his bicycle and clothes and also for consequential losses arising from the accident.

In the second case, Tym Burman was also injured after he was knocked off his bicycle at a roundabout. He was on his way to work and was leaving the roundabout when a vehicle drove into him.

Mr Burman suffered soft tissue injuries to his wrist, hip, spine and head. His bicycle and cycling kit were also damaged. The police cautioned the motorist for driving without due care and attention but no prosecution was brought because there was no independent witness evidence.

When Mr Burman brought a personal injury claim , the driver’s insurer disputed liability for the accident. However, after medical evidence was presented, an out of court settlement was agreed.
